Who doesn’t love the older Thomas and Friends Wooden Railway track and accessories? Especially the Clickety-Clack track that has little grooves in it to make the trains have a more “realistic sound” when they roll over. I always thought it was originally created by Learning Curve. It turns out that Learning Curve took the idea from Robert Clausi of PlayWood Toys, Inc. After a nearly decade long lawsuit, an appeals court jury finally awarded Clausi and the company a royalty of “8% for a license that would have been negotiated [absent the misappropriation] to last for the lifetime of the product. 1 While this is fascinating reading on case law of trade secrets, it’s not the reason behind this post.
